Canada-U.S. Trade Discussions

August 20, 2026

The potential implementation of a 50% ad valorem tariff by the United States under Section 338 of the Tariff Act of 1930 represents a significant economic challenge for Canada’s independent craft brewing sector. The measure is currently scheduled to take effect at 12:01 a.m. EDT on August 22, 2026, and would apply to Canadian alcoholic beverages, including craft beer, regardless of USMCA/CUSMA origin status.

We are grateful for the extension secured by the Canadian government and appreciate the considerable efforts being made to reach a negotiated resolution. We strongly encourage the government to continue prioritizing this issue as discussions with the United States proceed.

For years, Canadian independent breweries have built strong and mutually beneficial relationships with U.S. distributors, retailers, and consumers. A 50% tariff would significantly increase the cost of Canadian beer entering the U.S. market, disrupting established supply chains, putting additional pressure on small business margins, and limiting consumer choice.

While the broader trade dispute includes long-standing concerns related to provincial liquor board policies, the resulting tariffs could have a disproportionate impact on independent craft breweries that rely on predictable and open cross-border trade.

We urge both the Canadian government and U.S. trade authorities to continue their efforts toward an immediate negotiated solution. Resolving this issue is critical to protecting small businesses, regional jobs, established trade relationships, and fair market access for Canadian craft breweries.

We appreciate the efforts being made by the Canadian government and remain hopeful that a negotiated resolution can be reached quickly.
